Right of withdrawal for consumers
(A consumer is any natural person who concludes a legal transaction for purposes that can predominantly be attributed neither to his commercial nor to his independent professional activity.)

Right of withdrawal
You have the right to cancel this contract within 14 days without giving any reason.
The cancellation period is 14 days from the day
- on which you or a third party named by you, who is not the carrier, has or has taken possession of the goods, provided that you have ordered one or more goods as part of a single order and these are delivered uniformly;
- on which you or a third party named by you, who is not the carrier, has taken possession of the last goods, provided that you have ordered several goods as part of a single order and these are delivered separately;
- on which you or a third party named by you, who is not the carrier, has taken possession of the last partial shipment or the last piece, if you have ordered goods that are delivered in several partial shipments or pieces;
To exercise your right of withdrawal, you must inform us (Fiedler Garbarczyk GbR, Vonscheidts Hof 3, 45470 Mülheim an der Ruhr, E-Mail-Adresse:support@east45.info of your decision to withdraw from this contract by means of a clear statement (e.g. a letter sent by post). You can use the attached model withdrawal form for this, but it is not mandatory.
You can also complete and submit the sample withdrawal form or another clear statement electronically on our website (https://luka-designer-second-hand.de). If you make use of this option, we will send you a confirmation of receipt of such a revocation immediately (e.g. by e-mail).
To comply with the cancellation period, it is sufficient for you to send the notification of the exercise of the right of revocation before the expiry of the cancellation period.
Consequences of revocation
If you withdraw from this contract, we shall reimburse to you all payments received from you, including the costs of delivery (with the exception of the additional costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than 14 days from the day on which we are informed about your decision to withdraw from this contract. For this repayment, we use the same means of payment that you used in the original transaction, unless expressly agreed otherwise with you; in no case will you be charged a fee for this repayment.
We may refuse reimbursement until we have received the goods back or until you have provided proof that you have returned the goods, whichever is the earliest.
You must return or hand over the goods to us: Fiedler Garbarczyk GbR Vonscheidts Hof 3 45470 Mülheim an der Ruhr without undue delay and in any event not later than 14 days from the day on which you inform us of the cancellation of this contract. The deadline is met if you send the goods before the expiry of the period of 14 days.
You bear the direct costs of returning the goods.
You only have to pay for any loss in value of the goods if this loss in value is due to handling of the goods that is not necessary to verify the nature, characteristics and functioning of the goods.
Exclusion or Reasons for expiration
The right of withdrawal does not exist for contracts
- for the delivery of goods which are not prefabricated and for the production of which an individual selection or determination by the consumer is decisive or which are clearly tailored to the personal needs of the consumer;
- for the delivery of goods which may spoil quickly or whose expiry date would be quickly exceeded;
- for the delivery of alcoholic beverages, the price of which was agreed upon conclusion of the contract, but which can be delivered at the earliest 30 days after conclusion of the contract and whose current value depends on fluctuations in the market over which the entrepreneur has no influence;
- for the delivery of newspapers, magazines or magazines with the exception of subscription contracts.
The right of withdrawal expires prematurely for contracts
- for the delivery of sealed goods which are not suitable for return for reasons of health protection or hygiene if their seal has been removed after delivery;
- for the delivery of goods if these have been inseparably mixed with other goods after delivery due to their nature;
- for the delivery of sound or video recordings or computer software in a sealed package, if the seal has been removed after delivery.
